Fair Debt Collection Practices Act - Both Friend and Foe

Debt collection is one of the highly regulated industries in the United States today.  It does not matter what fancy or complimentary title you wish to adopt.  If you are in the judgment recovery or debt buying business, you will be classified a “debt collector” and subject to the Fair Debt Collection Practices Act (FDCPA) when collection from individuals.  The FDCPA is the business bible that you must embrace, learn in depth, and always apply in every transaction you process.

Contrary to what you may have heard or read in many industry articles, the FDCPA is not necessarily a tool that is used against you, although it can be used in that manner.  The FDCPA can be your best friend and one of the best protective shields the industry can provide.  You need to become aware of both sides of the coin.  The Judgment Recovery Institute (JRI) can be an essential aid in helping to insure you keep the FDCPA as your friend and not your foe by thoroughly teaching you every aspect of the legislation and proper application.  Follow up coaching and the answering of questions concerning gray areas will be invaluable to you.

The FDCPA is both a guide and code of conduct for debt collectors.  Conversely, the FDCPA provides valuable protections for debtors.  The FDCPA is a broad piece of legislation.  It will be wise for you to obtain your own copy as soon as possible.  Some important topics that will be critical in the day to operations of your judgment recovery business are:  proper hours for phone contact; cease communication requests, acceptable communication at places of employment; misrepresentation; deceit; improper disclosure; seeking unjustified amounts; and reporting of false information on a consumer’s credit report.  Each topic is a class in and of itself

FDCPA as Friend
If you conduct your business honestly, ethically, and in good faith concerning all the FDCPA regulations, you can be insured that the law will protect your rights to collect the debts your purchase every bit as much as protect the debtors you are collecting from.  Communication only how and when you are supposed to communicate.  Avoid any form of improper disclosure.  Do not threaten any action (legal or otherwise) that you cannot lawfully pursue.  Do not allow yourself to report any false information on a credit report.  When you do this, the FDCPA will allow you to pursue your business as fervently as you want.

FDCPA as Foe
Have no doubt in your mind that the FDCPA is a regulation designed in purpose to protect debtors from improper and illegal collection practices.  If you either knowingly, or unknowingly, violate the regulation, you can be subjected to severe monetary penalties.  You can open yourself up to lawsuits against you. There are many unscrupulous debtors out there that live to trap you into a violation to collect some easy money from you.  Get proper training on the FDCPA to keep it from becoming your worst foe.

Solution
The Judgment Recovery Institute is an excellent online source that provides experts to help guide you through the muddy, and sometimes difficult, waters of the FDCPA.   If you choose the Judgment Recovery Institute for instruction, you will receive so much more than you will find as an industry standard.  You will not be shipped an outdated and useless manual to read and understand on your own.  You will have access to all the tools that a Virtual Campus and Live Advisors can provide.  Access to a network of working professionals in the area of judgment recovery is granted.  The Judgment Recovery Institute can help you utilize the FDCPA as your friend and protection by showing you the pitfalls of the legislation and how it can be used against you.  Learn the FDCPA inside-and-out and up-and-down with fantastic help from the Judgment Recovery Institute.

Earn While You Learn

Bad debt in the United States has surpassed two (2) trillion dollars by many estimates. Even more startling news is that bad debt is accruing at seventy (70) billion dollars per year. There are vast amounts of money to be recovered in the judgment recovery business if you are willing to invest your time, hard work, and some of your money.

Judgment recovery and the purchasing of bad debt as a process is not brain surgery. You will purchase bad debt normally at four (4) cents to ten (10) cents on the dollar. At that point the debt is yours to collect. If you have purchased bad debt wisely, and work your business effectively and efficiently, you can possibly earn on average around twenty (20) cents on every dollar of bad debt purchased. The profit margin then is between one hundred and fifty (150) and two hundred (200) percent. If this realistic monetary gain does not give you a giant impetus to jump into the industry, then probably nothing ever will.

To be successful in the judgment recovery industry, you will want to obtain some very important skills. You will not want to go out and indiscriminately purchase bad debts without analysis. Being able to discern what debts to purchase and what debts to stay away from will take more than luck or intuition. Good debt buying practices are skills that have to be learned over time. The Judgment Recovery Institute can provide excellent training and knowledge that you will need to successfully purchase the “right” kind of bad debts.

The best news is the fact that you will NOT have to wait until you have learned everything there is to know before you start your business. You can begin studying with the Judgment Recovery Institute while you begin to work your business. If you need answers to questions that you have not covered and learned, you can contact an advisor to get the information you need. Perhaps you didn’t quite understand a lesson that you have previously covered. You can again get that missing information clarified in real time.

There is nothing wrong with starting out small so some of the trial and error is not as costly early on in the business. As you learn more you will no doubt earn more money. Earning while learning sure beats investing a chunk of money to “know it all” before you begin and then find out there are hundreds of things you need more information on to be successful. Don’t get stuck with a whole lot of questions not found in a book, manual, or system that you have been sold. Stick with experts who can guide you. Get a network of professionals to help you. The business you build will be your own, but the network access you obtain through the Judgment Recovery Institute will be an invaluable resource to you well worth the cost of tuition. You will not start out an industry “expert,” but you have the chance to eventually become an industry “leader.”

10 TIPS OF BECOMING A SUCCESSFUL JUDGMENT RECOVERY PROFESSIONAL

1.  Setting up your office correctly. - Many fail because they read books that tell them they have to do it all.  Their success is based solely on them.  Their knowledge, skill, money and time.  Which is a HUGH stress on the anyone starting a new business.  This is not true.  Be sure to set up your office with a team of knowledgeable players (attorneys, agencies, etc.) that can fill those weaker areas for you allowing you to get started in this business, make money while still learning the business.  You need to create a business that works when you don't or you will be a slave to your business FOREVER.  Be sure your office is lean (your office should not cost you more than $100 a month to keep open).  FAT offices are heavy burdens that no one should need to take on.
2.  Study and Learn -  Most of us rarely learn just by "reading" a book.  We normally need to see it and touch it (do it).  If you can, incorporate these training methods while you are learning and this will jumpstart your new business.
3.  Goal Setting - Create a blueprint of where you want to be at, when and how are you getting there.
4.  Organization - If you are not an organized person.  LEARN it now.  This can be another hidden killer in this business.
5.  Develop the correct inventory - You need to understand that all your inventory will not be collectable.  You need to build an inventory that should consist of 75% of judgments under $10K (as your collectability rate will be higher) than the remaining 25% of judgments (that exceed $10K).  You need to see the money so it is important to build the correct inventory to ensure the best chance of "seeing the green".
6.  Patience - Learn it if you don't have it already.
7.  Be creative - Learn to find the "sore spot" of your debtor.  This takes some creative thinking but once you find this spot = you have the Judgment Debtor's attention and you can smell the money.
8.  Case Assessment - Be sure you set some internal rules to help you work a file smart.  For example, if your office rule is to make $100 per hour and you are working a $1000 judgment at 50/50.  You need to give yourself 5 hours to work this file.  Keep track of your time and know when to quit.
9.  Persistence - Unlike #8 above, many Judgment Recovery Professional's quit too early because they have limited themselves in their asset finding skills or enforcement tactics.  If you have bitten on the Judgment Debtor's leg ........ stick with it.  With some persistence and time, either you will let go (quit) or the Judgment Debtor will drop to his knees (and pay).
10.  Be Proud - This can be a very rewarding business.  We are in our "perfect storm" and there is more inventory than ever for us to work.  Hold your head up high and be proud that you have taken the time to study and have the dedication & desire to keep learning.
Good Luck to each and every one of you.....
